Terms & Conditions
Effective from 6 April 2026
Welcome to Workshops in Africa (Pty) Ltd. By making a booking with us, you confirm that you have read, understood, and accepted these Terms & Conditions.
These Terms & Conditions apply to all workshops, retreats, tours, and related travel services offered by Workshops in Africa.

Bookings and Reservations
All bookings are subject to availability and are only confirmed once payment has been received and accepted by Workshops in Africa.
By completing your booking, you agree that your reservation is final and subject to the cancellation and refund terms set out below.

Cancellation and Refund Policy
- 2.1
Deposits
A deposit is refundable for up to 30 days from the date of payment, less any applicable bank charges and a 10% administration fee.
30 days after the payment date, the deposit becomes non-refundable.
- 2.2
Final Payments
If a booking is cancelled within three months of the workshop or retreat start date, no refund will be given, and the full retreat amount remains payable.

Non-refundable Bookings
Once payment has been made and a booking has been confirmed, the booking is considered final. No refunds or credits will be issued except where expressly stated in these Terms & Conditions.

Booking Changes and Modifications
Our non-refundable policy also applies to any changes or modifications made after a booking has been confirmed and payment has been processed.
No refunds, credits, or partial reimbursements will be issued for unused services, changes in travel plans, or amended arrangements after confirmation.

Retreat Cancellation by Workshops in Africa
In the unlikely event that Workshops in Africa has to cancel a guaranteed retreat due to force majeure, safety concerns, insufficient participation, supplier failure, or other circumstances beyond our reasonable control, participants will be notified as soon as reasonably possible.
Where applicable, Workshops in Africa will refund monies paid directly to us in accordance with these Terms & Conditions. However, we are not responsible for any additional costs incurred by the participant, including, but not limited to, flights, visas, accommodation outside the itinerary, travel disruptions, currency losses, or other third-party expenses.
Participants are strongly advised to ensure that their travel insurance covers these risks.

Refund Procedure and Chargebacks
If a refund is approved, it will be processed using the original payment method, where possible, less any applicable bank charges, transfer fees, and administration costs.
Workshops in Africa are not responsible for delays caused by banks, payment processors, or international transfer systems.
By booking with us, you agree not to initiate an unjustified chargeback for services that were booked under these Terms & Conditions. If a chargeback is raised in breach of these Terms, Workshops in Africa reserves the right to dispute it and recover any related costs.

Travel Insurance
All participants are required to obtain comprehensive travel insurance, including cover for:
- trip cancellation
- trip interruption
- medical emergencies
- emergency medical evacuation
- personal liability
- baggage loss or delay
- travel delays
- supplier or operator default, where available
It is the sole responsibility of each participant to ensure that their insurance policy provides sufficient cover for the full value of their trip and any related travel arrangements.
Workshops in Africa do not provide insurance and are not affiliated with any particular insurance provider. We may, however, assist by supplying the documentation required for a valid insurance claim.

Transfer of Booking
At our sole discretion, and subject to review and written approval, a booking may be transferred to another participant.
Any proposed replacement participant must be suitable for the specific workshop or retreat and may be required to demonstrate a genuine interest in the artist, instructor, or workshop format.
Transfer requests must be submitted in writing, together with the replacement participant’s full details. Workshops in Africa reserves the right to approve or decline any transfer request.
Any costs associated with the transfer may be charged to the original booking holder.

Food and Drink
Meals, beverages, and refreshments included in your booking will be specified in the relevant workshop or retreat itinerary.
Menus, inclusions, and arrangements may vary from retreat to retreat and may be subject to change due to availability, seasonality, supplier changes, or operational requirements.
Participants must notify us in advance of any dietary requirements, allergies, or medical conditions. While we will make reasonable efforts to accommodate such requests, we cannot guarantee that all dietary needs can be met.

Participant Responsibility
Participants are responsible for ensuring that they:
- hold valid passports, visas, and travel documents where required
- comply with all health, vaccination, and entry requirements
- arrive on time for all workshops, tours, and travel arrangements
- are physically and medically fit to participate in the booked activities
Any costs, losses, or disruptions resulting from a participant’s failure to meet these requirements will be borne by the participant.

Liability
To the fullest extent permitted by law, Workshops in Africa, its directors, employees, contractors, agents, affiliates, and service providers shall not be liable for any loss, damage, injury, delay, inconvenience, or expense of any nature whatsoever arising directly or indirectly from:
- participation in any workshop, retreat, tour, or related activity
- acts or omissions of third-party suppliers, lodges, reserves, transport providers, or other service providers
- theft, loss of baggage, loss of property, or damage to personal belongings
- illness, injury, death, accident, or medical emergency
- weather conditions, natural disasters, political unrest, strikes, pandemics, travel restrictions, or other events beyond our control
All activities are undertaken at the participant’s own risk.

Indemnity
By booking with Workshops in Africa, you agree to indemnify and hold harmless Workshops in Africa, its directors, employees, agents, contractors, and suppliers from and against any claim, liability, loss, damage, cost, or expense arising out of or in connection with your booking, participation, conduct, negligence, or breach of these Terms & Conditions.

Personal Property
Workshops in Africa are not responsible for the loss of, theft of, or damage to any personal belongings, luggage, art materials, equipment, or valuables brought by participants.
Participants are encouraged to keep valuables secure at all times and ensure appropriate insurance cover is in place.

Conduct and Right to Refuse Participation
We reserve the right to refuse a booking or remove any participant from a workshop, retreat, or activity, without refund, if their behaviour is unlawful, disruptive, abusive, unsafe, or negatively affects the experience of others.
This includes behaviour that places staff, artists, hosts, suppliers, or fellow participants at risk.

Photography and Media
Unless a participant expressly requests otherwise in writing, Workshops in Africa may use photographs or videos taken during workshops or retreats for promotional purposes, including on our website, social media, and marketing materials.
If you do not wish to appear in promotional content, please notify us in writing before the retreat begins.

Privacy
Workshops in Africa collect and process personal information to manage bookings, arrange travel services, communicate with participants, and deliver our services.
We are committed to protecting your privacy and taking reasonable steps to safeguard your personal information.
By booking with us, you consent to our sharing your personal information with relevant service providers and third parties, where necessary, to facilitate your travel arrangements and workshop experience.
We will only use your information in accordance with applicable privacy laws and our privacy practices.

Force Majeure
Workshops in Africa shall not be liable for any failure or delay in performing its obligations where such failure or delay is due to events beyond its reasonable control, including but not limited to natural disasters, extreme weather, war, terrorism, civil unrest, epidemics, pandemics, government restrictions, border closures, strikes, transport disruptions, or supplier failure.
In such cases, Workshops in Africa reserves the right to amend, postpone, or cancel the relevant arrangements as reasonably necessary.

Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of South Africa.
Any disputes arising out of or in connection with these Terms & Conditions shall be subject to the jurisdiction of the South African courts, unless otherwise required by applicable law.
